ARTICLE XXVIII - REPORTER PRIVILEGE
1. An employee may, without penalty in or prejudice to his or her employment, refuse to surrender custody of, disclose to or authenticate to, anyone other than the Publisher any information, in whatever form, or the source thereof, obtained in the course of his or her employment and relating to news, editorial or advertising matter.
2. The Publisher agrees to notify each employee and the Guild of any demand by public authority it receives for surrender, disclosure, or authentication of any such information or source.
3. If Public authority proceeds against an employee under any law or order because of his or her refusal to surrender, disclose, or authenticate any such information or its source, the Publisher will indemnify the employee against loss of compensation or other monetary benefit under this Agreement and all expenses he or she may incur by reason of such proceeding, including, but not limited to, attorney fees, expenses fines and damages.
4. It is further agreed that for an employee to benefit from paragraph three (3) above of this Article, the employee must cooperate fully with the Publisher and deliver to the Publisher and authenticate all information, in whatever form, he possesses on the subject of the proceeding. Failure to cooperate with the Publisher as outlined in this paragraph will absolve the Publisher of his obligation to render to an employee the protection specified in paragraph three (3) of this Article.
