ARTICLE II - GRIEVANCE & ARBITRATION


1. The Guild will designate a committee to take up grievances with the Publisher. A grievance will be defined as any matter involving interpretation, administration or application of this Agreement.

2. The Guild may file a grievance within 60 calendar days after the occurrence giving rise to same or within 60 days after the Guild (defined as its executive committee or any member thereof) should reasonably have been expected to have known of its occurrence. The Guild executive committee is composed of the president, vice president, treasurer, recording secretary and corresponding secretary.

3. The Publisher will meet with the Guild committee within five business days after submission of the grievance. The Publisher will reply to the Guild in writing within 15 business days following the meeting.

4. Any grievance not satisfactorily settled in the above manner may be submitted by the Executive Committee of the Guild to final and binding arbitration within 25 work days following receipt of the Publisher's answer.

5. Arbitration will be conducted under the provisions of the Voluntary Labor Arbitration rules of the American Arbitration Association. Each party will defray the expense of presenting its own case to the arbitrator. The expense of the arbitrator will be shared equally by the Publisher and Guild. Other incidental expense mutually agreed to in advance will be paid for equally by the parties. Neither party will be required to pay any part of the cost of a stenographic record without its consent, provided that failure of a party to share the cost of such stenographic record will be deemed a waiver of such party's right to have access to the record notwithstanding that a copy may be made available to the arbitrator (provided that the other party has been afforded the opportunity to review it) by the party purchasing same, at its sole discretion.

6. Failure by the Guild to adhere to the time limits will be a waiver of the grievance. Failure by the Publisher to adhere to time limits will automatically settle the grievance in the Guild's favor.

7. For the purpose of this article, "Business day" is defined as Monday through Friday non-holidays. Time limits expressed herein maybe extended by mutual agreement in writing.

8. Renewal of this contract will not be a dispute subject to arbitration as herein provided.

9. During the term of this Agreement neither the Guild, its officers, members or agents nor any employee will authorize, instigate, promote, sponsor, condone, aid in or engage in any strike, sympathy strike, slowdown, stoppage of work, interference with the operation or interruption of work of any kind. There will be no lockout during the term of this Agreement.
