ARTICLE XIII - JOB SECURITY


1. There will be no disciplinary discharges except for just and sufficient cause. The employee concerned and the Guild will be notified in writing at least two weeks in advance of any discharge, with the reason for the discharge stated in such notice. The provisions of this paragraph should not be applicable to economy dismissals. In the case of economy discharges, effected employees shall also be entitled to two weeks notice.

2. In the case of economy dismissals, the employee will be dismissed on a seniority basis within the job classification and will be placed on a seniority list for twelve (12) months and re-employed during that period as vacancies occur in their former classification, on a seniority basis.

3. When an employee is designated for dismissal for economy reasons, the employee so affected may: (1) elect dismissal with severance pay or (2) elect to return to a department and classification from which he was previously transferred or promoted and in which he served as a regular full-time employee and has seniority.

4. If the person so affected elects (2) above, then the employee with the least seniority in the job classification may be displaced to make room for the person so affected. If any employee is so displaced, such displaced employee will have the same rights of returning to a department and classification from which he was previously transferred or promoted and in which he has served as a regular full-time employee and has seniority.

5. Any transferred employee under this section will receive a weekly salary equal of what he or she would have received had he or she remained in the classification to which he or she is returned.

6. There will be no dismissals because of putting this Agreement into effect.

7. There will be no dismissals of or other discrimination against any employee because of his membership or activity in the Guild.
